Certificate of location
SALE · PURCHASE · MORTGAGEA certificate of location consists of a report and a colour plan prepared by a professional land surveyor. In this document, the land surveyor gives an opinion on the current situation and condition of your property in relation to the titles and the cadastre. The surveyor locates: the property lines, the buildings, the landscaping and occupancy features, servitudes, watercourses, protected zones and more. In the report, the land surveyor also comments on compliance with applicable laws and regulations and on any irregularity observed. Before investing in a property, check its “state of health” with a professional’s opinion!
Subdivision and cadastral operations
DIVISION · CORRECTION · SERVITUDESThe term “cadastral operation” refers to any operation carried out by a land surveyor that modifies a cadastral plan. The most common one, subdivision, is the operation by which an owner creates several lots within the limits of their property. Cadastral corrections and the creation of lots or parcels of land intended for sale are also cadastral operations.
Park fees – Your municipality may charge fees known as “park fees”. Your land surveyor will work closely with your municipality to define the options available to you.
Regulations – Several regulations govern subdivision. It is therefore important to consult a land surveyor to better assess the possibilities and profitability of this type of project. A Repèra land surveyor will support your decisions by producing clear draft plans with different subdivision options, as needed.
Technical description
SERVITUDE · NOTARIAL DEEDA technical description consists of a plan and a report. It is often used to define the shape and position of an existing or future servitude. It contains all the information needed to prepare the notarial deed used to publish the servitude. A technical description can also be used to describe any other type of land or structure.
Construction and layout
NEW CONSTRUCTION · EXTENSIONThe implantation certificate is a colour plan showing the proposed construction and the iron rods set on site. It provides several indications that make it easier to position the proposed construction — for example, the distances to respect from the rods set or from other physical features. If needed, our surveyor will assist you during construction.
Property lines: staking and boundary determination
FENCE · HEDGE · NEIGHBOUR DISPUTEBeware of this statement: “No problem, my land has been surveyed!” There are several ways to define your property lines, and they don’t all have the same legal effects or financial implications. For any boundary procedure, it is essential to involve a land surveyor early on. They will be happy to explain the different implications.
Staking
Staking is the most common, simplest and least costly boundary operation. It consists of setting survey markers to delimit your property. Staking does not have the same effects as boundary determination, because it is a unilateral operation that does not involve your neighbours. The position of the markers expresses your land surveyor’s opinion on the position of your property lines. This opinion may be contested by a neighbour. It is therefore not recommended if the position of your property lines is uncertain or could be viewed differently by another expert.
Amicable boundary determination without formalities
Amicable boundary determination without formalities is a boundary operation by which a land surveyor formalizes an agreement between neighbouring owners on the position of their dividing line. The land surveyor drafts minutes of boundary determination, including a plan (after the boundary markers are set in the presence of witnesses), which are signed by the owners concerned and published in the land register. The position of the markers sets the boundaries permanently, even for future occupants. Boundary determination is the procedure that offers the greatest land security.
Amicable boundary determination with formalities
Amicable boundary determination with formalities requires compliance with certain conventions imposed by law. This more complex procedure involves producing an expert report.
Judicial boundary determination
Judicial boundary determination is similar to boundary determination with formalities, but involves the Superior Court. The court rules at certain stages of the procedure, such as the choice of a land surveyor or another expert, or to decide the position of a dividing line. It is the most complex and costly boundary operation, since it involves legal fees. In the end, the court orders the markers to be set and validates the minutes of boundary determination. The position of the markers sets the boundaries permanently, even for future occupants.
